Maple Lodge Farms Ltd. failed, as an employer, to have a carbon dioxide sensor and alarm system in place. This was contrary to sections <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/90o01#BK52:~:text=(h)%20take%20every%20precaution%20reasonable%20in%20the%20circumstances%20for%20the%20protection%20of%20a%20worker%3B\">25(2)(h)<\/a> of the <em>Occupational Health and Safety Act<\/em><\/p><p><strong>Date of Offence:<\/strong> March 16, 2024<\/p><p><strong>Date of Conviction:<\/strong> August 27, 2026<\/p><p><strong>Penalty Imposed:<\/strong><\/p><ul>\t<li><span><span><span><span>Following a guilty plea in the Provincial Offences Court in Brampton, Maple Lodge Farms Ltd. was fined $500,000 by Justice of the Peace Damanpaul Dulai; Crown Counsel were Alicia Gordon-Fagan and Peter Gatti, law student.<\/span><\/span><\/span><\/span><\/li>\t<li><span><span><span><span>The court also imposed a 25 per cent victim fine surcharge as required by the <em>Provincial Offences Act<\/em>. The surcharge is credited to a special provincial government fund to assist victims of crime.<\/span><\/span><\/span><\/span><\/li><\/ul><p><strong>Background:<\/strong><\/p><ul>\t<li><span><span>Maple Lodge Farms Ltd. operates a poultry processing and packaging facility in Brampton.<\/span><\/span><\/li>\t<li><span><span>On March 16, 2024, a worker was in the facility's deli area when a hose carrying carbon dioxide ruptured.
