Stelco Inc. failed to ensure the measures and procedures prescribed under <a href=\"https:\/\/www.ontario.ca\/laws\/regulation\/900854#BK7\">section 196(2)(a)<\/a> of Ontario Regulation 854, Mines and Mining Plants, were carried out in the workplace, contrary to <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/90o01#BK47\">section 25(1)(c)<\/a> of the <em>Occupational Health and Safety Act<\/em>.<\/p><p><strong>Date of Offence: <\/strong>January 15, 2022<\/p><p><strong>Date of Conviction: <\/strong>February 26, 2024<\/p><p><strong>Penalty Imposed: <\/strong><\/p><ul>\t<li>Following a guilty plea in the Ontario Court of Justice, Hamilton, Stelco Inc. was fined $200,000 by Judge&nbsp;George Gage. The Crown Counsel was Dan Phelan.<\/li>\t<li>The court also imposed a 25 per cent victim fine surcharge as required by the <em>Provincial Offences Act<\/em>. The surcharge is credited to a special provincial government fund to assist victims of crime.<\/li><\/ul><p><strong>Background:<\/strong><\/p><ul>\t<li>On January 15, 2022, a worker employed by Stelco Inc. was working alone in the coal handling area of the plant and noticed a conveyor belt was slipping off its pulley.<\/li>\t<li>To fix the problem, it is believed the coal handler got a can of belt dressing (adhesion spray) and applied it between the belt and the pulley while the conveyor belt was still moving.<\/li>\t<li>About three hours later, a supervisor entered the work area and noticed the worker had been injured by the conveyor.
